As a result of the researches conducted on the causes of the dispute in the Turkish construction sector; Cost, payments, performance and quality of work, duration, legal issues, contractual relations, manufacturing prices, delays, contractor and owner responsibility, , extension of time, quality of works, uncertainties in job description, lack of information sharing, foreignness to local conditions, financial situations of the parties, planning errors, design-engineering errors, negligence of contract provisions, distribution of risks between the parties, differences in the parties’ perspective on disputes, unrealistic demand and expectations, payments, poor communication, differences in the way of doing business. These disputes reveal the necessity of preferring Mediation and Negotiation from the Alternative Dispute Resolution methods because the court proceedings provide long-term, costly, overt and unsatisfactory results.
