The Turkish energy sector underwent a fundamental structural change in 2001. In this new period, where a financially strong, stable, transparent and competitive energy market is aimed, the energy market has been reshaped with the legal regulations made and the laws regulating the energy market such as the Electricity Market Law, the Natural Gas Market Law and the Petroleum Market Law have entered into force. Given the volume and nature of the work and transactions in the energy sector subject to private law, on which the parties can freely dispose of, the expertise of mediators in this area will also facilitate and increase the resolution of disputes. Energy disputes are among the disputes that are in the interest of the parties to be resolved by alternative dispute ways, especially mediation, due to their nature. Due to the dynamic structure of the energy and mining sector, issues such as the need for rapid resolution of disputes and the assurance of the concept of “trade secret” with the principle of confidentiality in mediation bring mediation to the forefront in energy and mining disputes.
